What Does ‘Wrongful Death’ Mean?

A wrongful death claim is a lawsuit that is filed after a family member, usually a spouse or child, dies. In a wrongful death lawsuit, the death is shown to have been caused by someone else’s negligent or intentional act.

In a wrongful death lawsuit, I work to prove two things: liability and negligence.

  • Liability means that someone was responsible for what happened.
  • Negligence means that someone failed to do the right thing or take proper care.

If someone was in a car accident and killed by a drunk driver, then the drunk driver did not act responsibly when they drove drunk and caused the accident. The drunk driver is most likely liable and negligent. The same is true for a doctor who does not read a patient’s chart and, therefore, misdiagnoses the patient. A pharmacist who gives out the wrong medication because they are being careless can also be negligent and liable for the harm they cause.
